Terms of Service.

These Terms govern use of Music Intel's public websites and services, including Musicata, Musicata Pro and BlackBox Royalty Investigator. A signed order form, pilot agreement, enterprise agreement or DPA takes precedence where it says something different.

Acceptance.

By creating an account, installing our script, or using a Music Intel service (the "Service"), you agree to these Terms. The Service is provided by Music Intel Ltd ("the Company"), company number 17022941, registered in England and Wales with its registered office at Ingles Manor, Castle Hill Avenue, Folkestone, Kent CT20 2RD, United Kingdom. If you use the Service for an organisation, you confirm that you are authorised to do so.

Eligibility and accounts.

You must be at least 18 and legally able to enter contracts to open an account in your own name. An organisation may authorise staff, students or other users under its written agreement with Music Intel, subject to appropriate supervision and access controls. Keep credentials secure and tell us promptly about suspected misuse.

The Service.

Musicata provides artist-facing campaign and audience tools. Musicata Pro adds connected roster intelligence and workflows alongside customers' existing operational systems. BlackBox Royalty Investigator is a separate forensic investigation environment for authorised rights and royalty work. It is not royalty accounting, collection or legal advice.

We may update or improve features and may deprecate non-critical functionality with notice where practicable.

Customer data and privacy.

You retain your rights in Customer Data. You grant Music Intel Ltd the limited rights needed to provide, secure and support the Service. You must have the rights and lawful basis needed to supply or connect Customer Data. Music Intel remains responsible for its own obligations under applicable data-protection law and any agreed DPA. We do not sell Customer Data. Our Privacy Policy and Cookie Policy explain how our sites and services use personal data and storage technologies.

Third-party platform integrations.

The Service allows you to connect your accounts on third-party platforms ("Connected Platforms") to aggregate your audience metrics. Currently supported:

  • Meta (Facebook and Instagram) - page follower counts, Instagram follower counts, profile metadata.
  • Google (YouTube and Search Console) - subscriber counts, search performance data.
  • Spotify - follower counts, monthly listener counts.

(a) User-initiated connection. All platform connections are optional and initiated by you through OAuth authentication. By connecting a platform, you authorise Music Intel to access the specific data scopes described in our Privacy Policy.

(b) Data usage. We use Connected Platform data to provide the features, metrics and workflows described for the selected connection. The permission screen and Privacy Policy identify the relevant scopes. Unless a feature expressly says otherwise, we do not post on your behalf or access private messages.

(c) Disconnection. You may disconnect a Connected Platform through the controls made available for that connection. Retention and deletion after disconnection follow the applicable product notice, customer agreement and verified platform obligations.

(d) Third-party terms. Your use of Connected Platforms remains subject to the terms and policies of those platforms (e.g. Meta Terms of Service, YouTube Terms of Service). We are not responsible for changes to third-party APIs, rate limits, or access restrictions imposed by those platforms.

(e) No guarantee of availability. Third-party APIs may change, impose new restrictions, or become unavailable without notice. We do not guarantee continued access to any Connected Platform feature.

Security and data handling.

We use encrypted storage and industry-standard controls. You are responsible for securing your sites, API keys, and access tokens. Report security issues to security@musicintel.co.uk.

Fair use.

Plans include usage limits (events, retention, sites). Excessive load, automated abuse, or attempts to reverse-engineer or bypass safeguards may result in rate limiting or suspension.

Fees, billing, refunds.

Fees, billing cycle, renewal, cancellation, taxes and any refund terms are set out at checkout or in the applicable order form, proposal or enterprise agreement. Musicata subscription payments are handled through Stripe, Industry invoices are administered through Xero, and Spreadshirt handles merchandise checkout.

If you buy as a consumer, your statutory cancellation, refund and remedy rights continue to apply. Nothing in these Terms excludes a right or remedy that cannot lawfully be excluded. Business order forms and enterprise agreements may set different commercial terms where the law permits.

Beta features.

Free tiers, demonstrations, proofs of value, education pilots and beta features are available only where expressly offered or agreed. Their scope, duration, support and permitted use may be set out separately. Beta features are provided for evaluation, may change and may be withdrawn.

Prohibited uses.

No illegal, harmful or privacy-invasive use; no malware; no attempts to bypass security; and no use that violates applicable privacy, marketing, intellectual-property or other law. Resale and white-label use are allowed only where the applicable plan or written agreement expressly includes them.

Third-party services.

Optional integrations and third-party services are also subject to their own terms and privacy notices. Music Intel does not control third-party availability or independent processing, but this does not remove any responsibility Music Intel has for its own selection, configuration or use of service providers.

Intellectual property.

Music Intel owns the Service, software, and branding. These Terms do not grant you IP rights except the limited right to use the Service.

Confidentiality.

Non-public information disclosed by either party must be protected with reasonable care and used only to perform under these Terms. This does not apply to information already public or independently developed.

Disclaimers.

Except where a written agreement says otherwise, the Service is provided "as is" and we do not guarantee uninterrupted or error-free operation. Analytics, identity candidates and enrichment may depend on external signals and require human review. BlackBox does not make a legal conclusion, guarantee a match, establish entitlement or guarantee recovery.

Limitation of liability.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. To the maximum extent permitted by law, neither party is liable for indirect or consequential damages, lost profits, or loss of data. For business users, our total liability under these Terms is limited to fees paid in the three months preceding the claim unless a written agreement states otherwise. This cap does not restrict a consumer's non-excludable statutory remedies.

Indemnity.

If you use the Service in the course of business, you will indemnify Music Intel against third-party claims arising directly from your unlawful use of the Service or material breach of these Terms, including processing personal data without the notices or consent required by law. This section does not apply to a consumer except to the extent the law permits.

Suspension and termination.

We may suspend or terminate access for non-payment, abuse, security risk or legal compliance, subject to any applicable written agreement. Your cancellation and data-export options depend on the service and order terms. After termination, data is returned, deleted or retained in accordance with the applicable agreement, our legal obligations and the retention periods in our Privacy Policy.

Governing law.

These Terms are governed by English law, excluding conflict rules. The courts of England and Wales have exclusive jurisdiction, unless overridden by mandatory law.

Changes.

We may update these Terms to reflect product, legal or operational changes. We will identify the effective date and provide notice of material changes where required. Any acceptance or continued-use mechanism applies only to the extent permitted by law and does not override a signed agreement.

Groove derives pseudonymous hashes from browser and device capabilities, including canvas, WebGL and audio signals, and records interaction summaries. These are not loaded under Essential only.
